CampaMate Terms & Conditions
These Terms & Conditions apply to the CampaMate website, CampaMate mobile applications and the services and features provided through them.
Please read these Terms carefully before creating an account, starting a free trial, purchasing a membership or using CampaMate.
By using CampaMate, you agree to these Terms.
Nothing in these Terms affects your statutory rights as a consumer.
1. About CampaMate
CampaMate is a trading name used by Claire Hibbs and Harry Hibbs, trading in partnership as CampaMate.
In these Terms, “CampaMate”, “we”, “us” and “our” refer to that partnership.
Contact email: enquiries@campamate.com
Business/service address: CampaMate, The Cabin, 16 Bryants Close, Shillington, Hitchin, SG5 3PH
CampaMate is not currently a limited company and references to CampaMate in these Terms do not imply that it is incorporated.
2. What CampaMate provides
CampaMate is an all-in-one campervan and motorhome travel platform. Depending on your membership and the features currently available, CampaMate may provide:
- campsites and stopovers;
- facilities and essential services;
- route planning and road-trip tools;
- saved and community-shared routes;
- travel guides and information;
- checklists;
- CampFire community features;
- reviews and recommendations;
- campervan and motorhome private-sale listings;
- vehicle hire and buying information;
- campervan and motorhome business directories;
- user-submitted places and information; and
- other travel and community features.
Some features are free and others require a paid subscription or other payment.
3. Early access
CampaMate is currently being developed and expanded.
During early access, some sections, listings and features may be limited or incomplete and will continue to expand as CampaMate develops towards the full Version 1 (“V1”) platform.
Features may be added, changed, improved, replaced or temporarily unavailable.
We will take reasonable steps to provide a reliable service but cannot guarantee that an early-access service will always operate without interruption or errors.
4. Accounts
You must provide accurate information when creating a CampaMate account, including a valid email address.
You are responsible for keeping your login details secure.
You must tell us promptly if you believe your account has been accessed without your permission.
You must not create an account using another person’s identity or deliberately provide false or misleading information.
We may suspend or close an account where we reasonably believe that a user has:
- materially breached these Terms;
- acted fraudulently;
- seriously misused CampaMate;
- threatened the security of CampaMate;
- uploaded unlawful material; or
- used CampaMate in a way that could cause serious harm to CampaMate or another person.
5. Free access
CampaMate may provide certain features without a paid subscription.
Free access may have restrictions.
For example, some facilities, saved routes, planning tools, contact information or community features may only be available to paying members or users participating in an eligible free trial.
We may change the features available to free users as CampaMate develops.
6. 7-day free trial
Eligible new customers may receive a 7-day free trial of CampaMate’s paid membership.
Payment details are collected when the trial begins.
No subscription payment is taken when the free trial starts.
Unless you cancel before the trial ends, your subscription will automatically become a paid subscription and the payment method provided at checkout will be charged the price displayed when you signed up.
You may cancel during the free trial.
If you cancel before the trial expires, you will not be charged the subscription fee.
The price that will apply after your free trial and the applicable billing frequency will be displayed before you complete your subscription.
7. Early-access introductory membership
Customers joining under CampaMate’s qualifying early-access introductory offer may receive membership for:
49p per month.
Eligible early supporters will retain the 49p monthly price for three months following the release of CampaMate V1.
Following that introductory period, the membership will move to the applicable V1 subscription price.
The currently intended V1 prices are:
£1.99 per month
or
£16.99 per year
depending on the membership option selected and offered at that time.
The applicable price will be clearly communicated.
If an early-access subscription is cancelled and later restarted after the introductory offer has ended, the then-current public subscription price may apply.
8. Subscriptions and automatic renewal
Paid CampaMate subscriptions automatically renew unless cancelled.
Monthly subscriptions normally renew each month.
Annual subscriptions normally renew each year.
Before purchasing a subscription, you will be shown the applicable price and billing frequency.
By completing the subscription process, you authorise the applicable recurring payments until you cancel your subscription.
9. Payments
Subscription payments are processed using third-party payment providers such as Stripe.
Depending on availability, payment methods may include:
- debit or credit card;
- Apple Pay; and
- Google Pay.
CampaMate does not normally receive or store your complete payment-card details.
During private testing, certain payment functions may operate in test mode. Test transactions do not constitute actual payments.
10. Cancelling your CampaMate subscription
You may cancel your CampaMate subscription at any time.
Where available, cancellation can be completed through Manage Billing within your CampaMate account or membership area.
You may also contact: enquiries@campamate.com
Cancellation prevents the next automatic renewal.
Unless applicable consumer law requires otherwise, you will normally continue to have paid access until the end of the subscription period for which you have already paid.
If you cancel during your 7-day free trial before payment becomes due, no subscription payment will be taken.
11. Your UK consumer cancellation rights
Where you enter into a contract with CampaMate online as a UK consumer, you may have statutory cancellation rights under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, including a 14-day cancellation period where applicable.
These statutory rights are separate from CampaMate’s own subscription cancellation arrangements.
Where CampaMate begins providing a service during a statutory cancellation period, we may ask you to expressly request that the service begins immediately.
Where digital content is supplied immediately and this affects a statutory right to cancel, we will obtain any express consent and acknowledgement required by applicable consumer law.
If you exercise a statutory cancellation right, any refund or proportionate payment will be dealt with in accordance with applicable law.
You may tell us that you wish to exercise a statutory cancellation right by emailing: enquiries@campamate.com
Nothing in these Terms removes or restricts a statutory cancellation right that CampaMate is legally required to provide.
12. Refunds
Except where required by law, subscription payments relating to a subscription period that has already begun are normally non-refundable.
This does not affect your statutory rights.
Please contact us if:
- you believe you have been charged incorrectly;
- a payment was taken after a valid cancellation;
- you believe CampaMate has failed to provide a paid service as agreed; or
- you believe you are otherwise legally entitled to a refund.
Contact: enquiries@campamate.com
We will investigate and provide any refund or other remedy required by applicable consumer law.
13. CampaMate website and apps
A CampaMate membership may provide access to both the CampaMate website and supported CampaMate applications where those applications are available.
The same account may be used across supported CampaMate platforms.
Availability of a CampaMate app on a particular device or app store cannot be guaranteed.
Apps downloaded through third-party app stores may also be subject to the terms of the relevant app-store provider.
14. Travel information
CampaMate is a travel-planning and information service.
Information provided through CampaMate may originate from CampaMate, users, businesses, public datasets and third-party data providers.
Information can change and may occasionally be incomplete, inaccurate or out of date.
You should therefore verify important information before travelling. This may include:
- opening times;
- campsite availability;
- prices;
- access;
- parking restrictions;
- overnight-parking restrictions;
- vehicle size, height and weight restrictions;
- fuel availability;
- LPG availability;
- facilities;
- road restrictions;
- local rules; and
- campsite or landowner requirements.
A CampaMate listing does not itself grant permission to park, camp or stay overnight.
Users remain responsible for ensuring that they park, drive and stay overnight legally and safely.
15. Routes and navigation
CampaMate route-planning features are provided as planning aids.
Routes, road conditions, restrictions and access can change.
A route displayed through CampaMate may not be suitable for every campervan or motorhome.
You remain responsible for:
- observing road signs;
- complying with road laws;
- checking vehicle restrictions;
- assessing road conditions; and
- driving safely.
Do not rely solely upon CampaMate where doing so could create a safety risk.
16. User-submitted places and information
Some CampaMate locations and information may be submitted by members of the CampaMate community.
Community-submitted information should not automatically be treated as verified by CampaMate.
Users should carry out appropriate checks before relying upon community-submitted information.
We may edit, reject, remove or investigate submitted information where reasonably necessary.
17. CampFire community
CampFire is CampaMate’s community area.
Users may be able to submit:
- posts;
- comments;
- photographs;
- reviews;
- recommendations;
- routes;
- places;
- links; and
- other community content.
You are responsible for content you submit.
You must not submit material that is unlawful, fraudulent, threatening, discriminatory, defamatory, deliberately misleading, infringing, sexually explicit or seriously abusive.
CampaMate may use automated and/or manual moderation.
We may restrict or remove content that breaches these Terms or applicable law.
The appearance of user-generated content on CampaMate does not mean that CampaMate has verified or endorsed it.
18. Your content
You retain ownership of original content you submit to CampaMate.
By submitting content, you confirm that you have the right to provide it.
You grant CampaMate a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, display and use the submitted content where reasonably necessary to operate, provide, moderate and promote CampaMate.
This may include displaying your submitted routes, reviews, photographs, recommendations or place information to other CampaMate users.
19. Reviews
Reviews and recommendations must represent genuine experiences or opinions.
You must not:
- knowingly submit a fake review;
- pay for or commission fake reviews;
- impersonate another person;
- deliberately manipulate ratings;
- submit deliberately misleading reviews; or
- conceal a commercial relationship where disclosure is legally required.
We may investigate or remove reviews we reasonably believe are fraudulent, misleading or unlawful.
20. Campervan and motorhome vehicle sales listings
CampaMate may provide a platform through which users and selected dealerships can advertise campervans and motorhomes for sale.
Vehicle listings are also governed by the separate CampaMate Vehicle Sales Terms & Conditions.
The standard vehicle-listing options are a £14.99 one-off fee per vehicle listing or an active £16.99 annual CampaMate membership, which includes a vehicle listing without an additional listing fee. A monthly CampaMate subscription does not include a free vehicle listing. Monthly paying members must either upgrade to the £16.99 annual membership or pay the £14.99 one-off listing fee.
Unless expressly stated otherwise, CampaMate:
- does not own the vehicle;
- is not the vehicle seller;
- is not acting as a motor dealer;
- is not acting as a broker;
- does not receive the vehicle purchase price; and
- is not a party to the sale contract between the buyer and seller.
The £14.99 charge is an advertising/listing fee paid to CampaMate and is not a payment towards the purchase price of a vehicle.
Buyers and sellers are responsible for carrying out their own checks before completing a transaction.
21. Business directory, hire and third-party services
CampaMate may display information about third-party businesses including campsites, vehicle-hire businesses, campervan and motorhome services, repairers, converters and other suppliers.
Unless expressly stated otherwise, inclusion within CampaMate does not constitute a guarantee or endorsement of a business.
Users should make their own enquiries before entering into a contract with a third-party provider.
Any contract entered into directly between a user and a third-party business is between those parties.
22. Maps and third-party data
CampaMate may use mapping and location information from third-party providers.
This may include OpenStreetMap data © OpenStreetMap contributors, available under the Open Database Licence (ODbL).
Directions or navigation may also be provided through or opened in third-party services such as Google Maps or Apple Maps.
Third-party services have their own terms, policies and privacy practices.
23. CampaMate content, branding and database rights
The CampaMate name and branding may be protected by registered and/or unregistered intellectual-property rights.
Original CampaMate written content, graphics, software, designs, compilations and qualifying proprietary database material may also be protected by copyright, database rights and other applicable intellectual-property laws.
The CampaMate Content & Data Usage Policy forms part of these Terms.
Unless authorised by CampaMate or permitted by law, you must not:
- systematically copy CampaMate’s proprietary database;
- scrape or harvest substantial quantities of CampaMate data;
- reproduce CampaMate’s proprietary material for commercial use;
- create or populate a competing database using protected CampaMate material;
- circumvent technical measures designed to protect the Platform; or
- falsely represent CampaMate material as your own.
Nothing in these Terms claims ownership of third-party or open-source/open-data material which CampaMate does not own.
24. Acceptable use
You must not:
- interfere with CampaMate’s normal operation;
- attempt unauthorised access to CampaMate systems or accounts;
- introduce viruses or malicious software;
- use automated systems to abusively scrape CampaMate;
- spam or harass other users;
- use CampaMate fraudulently;
- upload unlawful or infringing material;
- impersonate another person;
- deliberately provide false information;
- misuse another user’s account; or
- falsely describe community information as verified by CampaMate.
25. Service availability
We aim to provide a reliable CampaMate service but cannot guarantee uninterrupted availability.
Maintenance, updates, technical failures, third-party outages and circumstances outside our reasonable control may occasionally affect CampaMate.
This is particularly relevant during early access while the Platform is actively being developed.
26. Changes to CampaMate
We may modify CampaMate where reasonably necessary to:
- improve the service;
- introduce features;
- fix technical problems;
- maintain security;
- comply with legal requirements; or
- replace features that are no longer practical to maintain.
We will act reasonably where a change materially affects a paid membership.
27. Liability
Nothing in these Terms excludes or limits liability where doing so would be unlawful.
In particular, nothing in these Terms excludes or limits liability for:
- death or personal injury caused by negligence;
- fraud or fraudulent misrepresentation; or
- statutory consumer rights or other liability which cannot legally be excluded.
CampaMate provides travel information and planning tools rather than guarantees concerning particular locations or journeys.
Subject to applicable law, CampaMate is not responsible for losses caused solely by a user’s decision to rely on inaccurate community information, third-party information, route suggestions or information that the user knew or reasonably should have known required independent checking.
Nothing in this section removes any responsibility CampaMate has under applicable consumer law.
28. Privacy
Our handling of personal information is explained in the CampaMate Privacy Policy.
You should read the Privacy Policy alongside these Terms.
29. Changes to these Terms
We may update these Terms where reasonably necessary because of changes to:
- CampaMate;
- membership features;
- consumer law;
- regulatory requirements;
- payment arrangements;
- security; or
- other services provided through the Platform.
Where a change materially affects an existing paid membership, we will take reasonable steps to provide appropriate notice.
Any specific introductory-price commitment already made to qualifying early supporters will be honoured according to the applicable offer.
30. Ending CampaMate services
You may stop using CampaMate at any time.
Paid subscriptions may be cancelled as explained above.
We may discontinue all or part of CampaMate where reasonably necessary.
If we permanently discontinue a paid service during a period for which a customer has already paid in advance, we will provide any refund or other remedy required by applicable law.
31. Complaints
If you have a complaint about CampaMate, please contact: enquiries@campamate.com
Please provide enough information for us to investigate the issue.
We will aim to respond within a reasonable period.
32. Governing law and consumer rights
These Terms are governed by the applicable laws of the United Kingdom.
If you are a consumer, you retain any mandatory legal protections available to you in the part of the United Kingdom in which you live.
Nothing in these Terms prevents a consumer from exercising any right to bring proceedings in a court available to them under applicable law.
Nothing in these Terms affects statutory consumer rights that cannot legally be excluded or restricted.
